SIPKO Security · Purchase & Service Terms

These Terms and Conditions apply when you purchase products, accept a quotation,
book security services or place an order with SIPKO Security. They explain when
a contract is formed and how pricing, payment, delivery, installation,
cancellations, warranties and customer rights are handled.

Australian Consumer Law:
these Terms do not exclude, restrict or modify any consumer guarantee,
right or remedy that cannot lawfully be excluded, restricted or modified.

1. About these Terms

These Terms and Conditions (“Terms”) apply to products and services supplied by
SIPKO SECURITY PTY LTD
(“SIPKO Security”, “we”, “us” or “our”).

A written quotation, scope of works, invoice, order confirmation or other
expressly agreed document may contain additional transaction-specific terms.
A specifically agreed term prevails over these general Terms to the extent of
any inconsistency, subject to applicable law.

2. When a contract is formed


When is an online order binding?

An online contract is formed when SIPKO Security communicates that your order
has been accepted for fulfilment. An automated acknowledgement that we have
received your order is not, by itself, acceptance of the order.

Placing an online order is an offer to purchase the selected products or
services on these Terms and on any specific conditions displayed before checkout.

Before accepting an online order, we may check product availability, pricing,
payment status, delivery details, suspected fraud and other information
reasonably necessary to process the transaction.

For quotation-based work, a contract may be formed when you sign or expressly
approve the quotation, clearly accept it in writing, or pay a deposit or other
amount where the quotation states that payment constitutes acceptance.

3. Products and services

SIPKO Security supplies security products and related services, which may
include alarm systems, CCTV, access control, security components, installation,
configuration, maintenance and technical support.

The products and services included in a transaction are those identified in
the applicable product description, quotation, order confirmation or scope of works.


Installation is not automatically included with every product.

Installation, configuration, monitoring, subscriptions or other services are
included only where this is stated in the product description, checkout,
quotation or order confirmation.

4. Quotes and variations

A quotation sets out the proposed scope, equipment and price based on the
information reasonably available when it is prepared.

A quotation remains valid for the period stated in it. If no validity period
is stated, pricing and availability may need to be reconfirmed before acceptance.

Previously unknown site conditions may affect the appropriate installation
method or scope of work.

We will inform you before carrying out a material variation that creates an
additional charge and will obtain approval before proceeding, except where
immediate action is reasonably necessary for safety and the law permits it.

5. Prices, GST and other charges

Prices are in Australian dollars unless expressly stated otherwise.

Consumer-facing prices include GST where applicable and will be displayed
in accordance with applicable Australian pricing requirements.

Delivery charges, optional extras and any payment fees or surcharges, if any,
will be disclosed before you complete an online purchase and will apply only
where permitted by applicable law and payment-network rules. The total amount
payable will be shown before the order is submitted.

6. Payment

The payment methods available for an online order will be shown at checkout.
Payment may be required in full at checkout or according to the schedule
stated in a quotation, invoice or order confirmation.

If a deposit is required, its amount and any transaction-specific cancellation
conditions will be disclosed before acceptance.

Before accepting an online order, we may delay processing while reasonably
verifying payment, suspected fraud, a material pricing error or other
information necessary to process the transaction. If an order cannot be
accepted after payment has been received, we will provide the remedy required
by applicable law.

7. Product and service availability

Products, components, appointment times and installation dates are subject to availability.

If we become aware that an accepted order cannot be supplied as agreed,
or will be materially delayed, we will contact you and explain the available options.

We will not knowingly accept payment for a product or service that we do not
intend to supply or know we cannot supply as promised.

8. Delivery and collection

Where delivery is offered, you must provide a complete and accurate delivery
address and suitable contact information.

Delivery dates are estimates unless a specific delivery commitment has been
expressly agreed.

Nothing in these Terms limits rights you may have where goods are not supplied
within an agreed time or, where no time was agreed, within the period required
by applicable law.

9. Installation, repair and service visits

Where onsite work is included, you must provide reasonable access to the
property and to the areas required to perform the agreed work.

Installation may depend on suitable power, cabling, network infrastructure,
building access and compatibility with existing equipment.

If previously unknown site conditions make the work unsafe, technically
unsuitable or materially different from the agreed scope, we may pause the
work and discuss available options before proceeding.


Known hazards

Please tell us before a service visit about known asbestos, hazardous materials,
unsafe electrical conditions, restricted access or other hazards relevant to the work.

10. Customer responsibilities

You are responsible for:

  • providing accurate information reasonably required for the order or service;
  • having authority to instruct us to perform work at the property;
  • obtaining owner, landlord, body corporate, strata or other approvals where required;
  • providing reasonable and safe access for agreed onsite work;
  • telling us about known hazards or restrictions;
  • maintaining power, internet, Wi-Fi, mobile connectivity or other infrastructure outside our agreed scope where the system depends on it; and
  • maintaining appropriate passwords and credentials for systems under your control.

11. Security-system limitations

Security systems are designed to reduce risk, improve detection and provide
information or alerts. No alarm, CCTV, access-control or other security system
can guarantee that theft, intrusion, property damage, personal injury or
another incident will never occur.

Operation may depend on electricity, batteries, internet connectivity, Wi-Fi,
mobile networks, cloud platforms, manufacturer services or other third-party infrastructure.

You should test and maintain the system as recommended and contact us if you
become aware of a fault or abnormal operation.

12. CCTV, audio recording and surveillance

Laws may regulate CCTV, audio recording, workplace surveillance and the
collection, use or disclosure of recordings.

After installation, the customer is responsible for operating the system
lawfully, including obtaining notices, permissions or consents required for
the customer’s particular use of the system.


SIPKO Security’s own obligations remain applicable.

The customer’s responsibility for ongoing lawful use does not exclude or reduce
any legal, licensing or professional obligation that applies to SIPKO Security
when designing, positioning, installing or configuring equipment.

General information about camera positioning or security practices is not legal
advice. If you are uncertain about surveillance or privacy obligations applying
to your premises, obtain appropriate legal or professional advice.

13. Cancellations, deposits and change of mind

If you need to cancel or change an order, booking or accepted quotation,
contact us as soon as possible.

Where a transaction-specific cancellation charge has been disclosed before
acceptance, that charge will be limited to reasonable costs or losses associated
with the cancellation and will operate only to the extent permitted by law.

We will not automatically retain an entire deposit or prepayment merely because
a cancellation occurs. Any amount retained must be consistent with the agreed
terms, reasonable costs or losses and applicable law.

A cancellation charge or deposit condition does not apply to the extent that
you have a statutory right to cancel, reject goods, terminate a service or
obtain another remedy.

Australian Consumer Law does not generally require a refund solely because a
customer changes their mind. Any voluntary change-of-mind policy we offer will
be communicated separately and does not reduce statutory rights.

14. Australian Consumer Law and consumer guarantees

Statutory consumer rights remain available.

Products and services supplied to consumers may come with guarantees under
the Australian Consumer Law.

Depending on the nature of a failure and the circumstances, remedies may include
repair, replacement, refund, cancellation of a service or compensation for
reasonably foreseeable loss or damage.

The available remedy, and who may choose it, can depend on whether the failure
is major or minor and whether it can be remedied within a reasonable time.

15. Manufacturer warranties and your ACL rights

Some products may include a manufacturer’s voluntary warranty. The manufacturer
determines the terms, duration and process for a claim under that separate warranty.


You are not required to deal only with the manufacturer.

If SIPKO Security supplied the product, you may contact SIPKO Security about
rights and remedies available under the Australian Consumer Law. Where we have
obligations as the supplier, we will not require you to deal only with the manufacturer.

Manufacturer warranties and any additional warranty offered by SIPKO Security
operate in addition to statutory consumer rights and do not replace them.

16. Third-party platforms, subscriptions and monitoring

Some security equipment may depend on manufacturer applications, cloud storage,
mobile services, SIM services, internet connections, monitoring providers or
other third-party platforms.

Third-party subscriptions, licence fees or recurring charges are included only
where expressly stated in the product description, quotation or order.

Where a third-party account or ongoing service is required, that provider may
impose its own terms and privacy policy. Any professional monitoring arrangement
supplied through SIPKO Security will be described in the relevant agreement.

17. Liability and events outside reasonable control

Nothing in these Terms excludes or limits liability, rights or remedies to the
extent they cannot lawfully be excluded or limited.

Subject to that qualification, a delay or failure caused by circumstances
outside our reasonable control will be addressed according to the circumstances,
the affected contractual obligations and applicable law. Examples may include
significant supplier disruption, telecommunications outages, severe weather
or emergency restrictions.

18. Website information and intellectual property

We aim to keep product descriptions, availability and website information accurate.
Packaging, manufacturer images or appearance may change where the change does
not materially alter the product supplied.

If a material website or pricing error affects a pending transaction, we will
inform you and address the transaction before fulfilment where practicable.

Original website text, branding, graphics and other material owned by SIPKO
Security may not be commercially reproduced without permission except where
permitted by law. Third-party trademarks remain the property of their owners.

20. Changes to these Terms and governing law

We may update these Terms for future transactions. A later website update
does not retrospectively alter an already accepted contract unless the change
is required by law or separately agreed with you.

These Terms are governed by the laws applicable in Victoria, Australia,
together with applicable Commonwealth law. This clause does not remove any
mandatory legal right or jurisdiction that cannot lawfully be excluded.
